UPDATED – IRS Extends Tax Relief to Victims of Hurricane Ian by Tony Gutierrez, CPA
The IRS has extended until Feb. 15, 2023, various tax-filing and tax-payment deadlines for individuals and businesses recently impacted by Hurricane Ian, which made landfall on Florida’s west coast on Sept. 28, 2022.
The postponed deadline applies automatically to taxpayers with homes or businesses located anywhere in the states of Florida, North Carolina and South Carolina. Taxpayers eligible for this relief include:
- Individuals and businesses whose principal residence or place of business is located anywhere in Florida, North Carolina and South Carolina;
- Businesses that do not have operations in Florida, North Carolina and South Carolina but do maintain records in the state;
- Estates and trust whose records required to meet tax filing and payment deadlines are located anywhere in Florida, North Carolina and South Carolina
- Spouses of affected taxpayers who file joint tax returns; and
- Individual relief workers assisting in a covered disaster area, regardless of whether they are affiliated with recognized government or philanthropic organizations.
The tax reporting and payment obligations qualifying for the Feb. 15, 2023, deadline without risk of penalty include the following:
- 2021 individual tax returns on a valid filing extension (with an extended due date to file on Oct. 17, 2022). Please note that because tax payments related to the 2021 individual tax returns were due on April 18, 2022, said payments are not eligible for this relief.
- 2022 individual fourth-quarter estimated-tax payments (with an original deadline of Jan. 17, 2023)
- 2022 business quarterly payroll and excise tax return filings (with original due dates of Oct. 31, 2022, and Jan. 31, 2023.
- Businesses with original or extended due dates, including calendar-year corporations whose 2021 extensions run out on Oct. 17, 2022.
- Tax-exempt organizations with extensions for filing 2021 calendar-year returns with extensions due to run out on Nov. 15, 2022.
